The incident involved Kevin Costlow, a 52-year-old man who was shot and killed by a Montgomery County (Maryland) deputy. Sgt. Frank Pruitt. Costlow attacked vehicles and the deputy with a large tree branch or stick.

What happened: On the morning of February 6, 2021, Costlow caused two collisions on Olney–Laytonsville Road. He exited his vehicle and struck bystanders and other vehicles with a substantial tree branch which was initially mistaken for a baseball bat. When Sgt. Pruitt responded, he attempted to subdue Costlow with a Taser, but it failed to incapacitate him. Costlow continued advancing and repeatedly struck the deputy in the head and shoulder with the branch. Eventually, Pruitt opened fire, discharging 12 rounds, 10 of which struck Costlow in the torso. Costlow did not stop moving toward the deputy until he collapsed.

Investigations and legal outcome: The Howard County State’s Attorney’s Office tasked with reviewing the use-of-force incidents involving Montgomery County, determined the shooting was legally justified.

No charges were filed against Sgt. Pruitt.
